On\u00a0September 28th<\/b>,\u00a0U.S. District Judge Katharine S. Hayden<\/b>\u00a0denied\u00a0Sylvester Stallone<\/b>‘s bid to dismiss the lawsuit filed by\u00a0Chuck Wepner<\/b>\u00a0which claims that\u00a0Stallone<\/b>\u00a0inappropriately used\u00a0Wepner<\/b>‘s name to promote his\u00a0“Rocky”<\/b>\u00a0movies.<\/p>\n

However,\u00a0Judge Katharine S. Hayden<\/b>\u00a0dismissed two other claims by the ex-boxer: 1) that\u00a0Stallone<\/b>\u00a0was unjustly enriched by trading on\u00a0Wepner<\/b>‘s life story and 2) that\u00a0Wepner<\/b>\u00a0suffered by relying on\u00a0Stallone<\/b>‘s promises.<\/p>\n

Wepner<\/b>‘s lawyer\u00a0Anthony G. Mango<\/b>\u00a0called the ruling a “100% victory.” [Uh, but weren’t TWO of the THREE claims dismissed? 100% Victory? More like 33%, I’d say. –\u00a0Craig<\/b>]\u00a0Sly<\/b>‘s attorney,\u00a0Jon Paul Robbins<\/b>, declined to comment preferring to not try the case in the media.<\/p>\n

As to the one claim that was allowed to go forward\u00a0Judge Hayden<\/b>\u00a0stated that “Wepner<\/b> contends, and Stallone<\/b>\u00a0does not contest, that the main character,\u00a0Rocky Balboa<\/b>, was based on\u00a0Wepner\u00a0<\/b>and the plot of the first movie was inspired on the\u00a01975<\/b>\u00a0fight.”<\/p>\n

It’s not unusual for a\u00a0judge<\/b>\u00a0to allow a case to proceed to trial so that a\u00a0jury\u00a0<\/b>can decide the outcome of the claims. The fact that two of\u00a0Wepner<\/b>‘s claims were dismissed is good news for\u00a0Sly<\/b>. The claim that did go forward doesn’t seem to have a solid foundation since\u00a0Wepner<\/b>\u00a0has no contracts and he benefitted from his association to\u00a0Rocky<\/b>. I’m sure it can be easily proved that his appearances and income went up AFTER Sly<\/b>\u00a0spoke of his inspiration for\u00a0Rocky<\/b>. I’d also bet that\u00a0Wepner<\/b>\u00a0used\u00a0Sly<\/b>‘s name in his appearances! –\u00a0Craig<\/b><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
